Request Haywood County Court Records

Haywood County court records start with the clerk of superior court, who keeps the filings, orders, hearing history, and results for the county trial courts. A free online Case Summary can answer basic questions first. When you need the actual file, a copy, or a certified version, take the case number to the clerk. Access works differently for public documents, paper files, recordings, and legally restricted records.

Getting Haywood County Court Records

Charlie Plemmons is the Haywood County Clerk of Superior Court. His office holds the Superior Court and District Court files, dockets, and indexes. Begin online. The free North Carolina Judicial Branch Portal (Search/Pay) works well here. Bring a record number or a party name. Smart Search pulls up the Case Summary, sometimes called the Register of Actions. A public document link appears there too, whenever a filed item can be viewed. Save the full case number before you call anyone.

Need a document, a paper file, or a certified copy? Use the Haywood clerk counter or the public self-service terminal. Call ahead at (828) 454-6501, especially for older records, thin portal results, or limited access. Keep the party name, case number, and exact document title handy. Mail requests use one published address. It is Clerk of Superior Court, Haywood County Courthouse, 215 N. Main St., Waynesville, NC 28786, for correspondence and payment. The published visit address is different and appears below.

  1. Search Portal by the full case number when known, or by a party name with Haywood selected.
  2. Open the Case Summary and note the case number, court division, and exact document or copy needed.
  3. Ask the Haywood clerk by phone, at the counter, or through the courthouse terminal how the file can be inspected or copied.
  4. Use the clerk's published mail route only after confirming that mail is suitable for the requested record and payment.
  5. Request a plain copy or ask whether a certificate under seal is needed for the purpose at hand.

See the Judicial Branch's clerk-terminal and records instructions before a visit.

Haywood County court record access through the clerk terminal

The terminal and paper-file route still matters when a Haywood County court record is not fully shown online. A web display can help you identify a case, but the clerk alone controls copies and certifications of the underlying Haywood County court record.

Haywood County Court Record Search Paths

Portal is for viewing, not filing. Its Smart Search can return case information, assignments, parties, events, hearings, dispositions, and financial information. Those fields appear only where they exist. For a current setting, Search Hearings is the better channel. Portal does not release every filed document. A missing section never proves the court holds nothing.

The statewide Judicial Branch public-record request form serves a different job. It covers existing Judicial Branch administrative records only. The form itself says NCAOC is not the custodian. It does not hold court documents or county case information. So it cannot replace a Haywood County court case-file request sent to the clerk. The Judicial Branch form page spells out that administrative-record route.

For a local Haywood case file, the clerk stays the practical contact after a Portal search.

Court Record Types

Haywood County court records sit in one unified clerk system, not separate county and district clerk offices. The clerk keeps Superior Court felony and major-civil files, District Court misdemeanor and infraction files, civil and family matters, special proceedings, estates, and magistrate matters. Contents and public access rules vary by case type.

  • Case Summaries or Registers of Actions showing the chronological case record.
  • Publicly available pleadings, motions, orders, judgments, and other filed documents.
  • Criminal, infraction, and traffic case files held through the District Court and clerk system.
  • Civil, family, special-proceeding, and estate files that the clerk indexes and maintains.
  • Magistrate and small-claims matters within the same county court and clerk route.

Some Haywood County court records begin as paper files, or keep paper material even after the county's eCourts conversion.

Haywood County Court Record Access

A courthouse terminal gives a second search option when Portal falls short. Statewide guidance says clerk offices provide self-service terminal access. It is public, and it covers criminal, civil, special-proceeding, and estate case systems. Haywood has not published its terminal count, floor, or staff-assistance policy. Call first. Do not assume a location or service level.

Inside a Haywood County Court Record

A Case Summary is the indexed timeline of a Haywood County court record. The full file may hold documents behind that timeline. Portal shows only the fields that apply. Not every case gets every field. A civil cause-of-action block is one example. It may appear for qualifying civil, family, probate, or mental-health matters. A financial section appears only when there is information to show.

AssignmentThe court or judicial assignment listed for the Haywood County court record.
PartiesParty information, with victims omitted from Portal results.
Events and hearingsCase events, the Register of Actions chronology, and hearing information.
Disposition and financesThe displayed result and financial information when applicable.
Public documentsPublic filings or documents that have been made viewable online, subject to access rules.

Portal may mask date-of-birth information and does not validate Social Security numbers, so an online result does not mirror every field the court stores.

Haywood County Court Record Layers

Three different things get called a court record. Each answers a different need. A Case Summary helps you locate and follow a matter. A filed document is the underlying record. It may be a pleading, order, or judgment, and it counts when it is public and available. A clerk-provided certified copy is an official copy bearing the clerk's certification. Knowing which layer you need makes a Haywood request far more precise.

Fees and Certified Copies

The statewide January 2026 miscellaneous-costs chart and G.S. 7A-308 set the listed clerk charges used in Haywood unless a different specific service applies. Portal searching is free. The chart lists no separate universal certified-copy surcharge beyond a certificate under seal, so do not assume an extra fee the sources do not name.

2026 clerk serviceAmount
Copy preparation, first page of each document$2.00
Copy preparation, each additional page or fraction$0.25
Certificate under seal$3.00
Exemplification$10.00
Single-county criminal-record search$25.00

The statutory clerk-fee authority is available in G.S. 7A-308.

Call the Haywood clerk before mailing any payment for a copy or certification. Ask exactly what the service costs and how the procedure works. The clerk sets the payment method, identity requirements, and turnaround for each request, so confirm those details directly rather than guessing.

Haywood County Court Audio Requests

Want audio of a non-confidential Haywood County hearing that a clerk or digital technician recorded? The form to use is AOC-G-114. It asks for the county, case name, file number, proceeding date, presiding judge or clerk, and courtroom. District Court or Superior Court? It asks that too. You also supply a requester name, phone number, request date, and signature. Email is optional.

Delivery options include a temporary LiquidFiles email link, blank media, or a CD. The fee equals the actual cost of the blank media. Payment can be cash, certified check, or money order made payable to the Clerk. Personal checks are not accepted. Reporter transcripts and reporter audio go through a separate process. Juvenile or confidential hearings require a different authorized route. The official AOC-G-114 request page lays out the non-confidential recording process in full.

Fill in the case and hearing details carefully. Those specifics let the Haywood clerk pull the exact recording from the court docket rather than the general case file.

Sealed Records and Public Access

Under G.S. 7A-109, clerks must keep records, files, dockets, and indexes open for public inspection during regular office hours. A different law can say otherwise. The same statute allows remote electronic access arrangements. It does not shift custody away from the Haywood clerk. The clerk still holds the court records.

Access has limits, though. Sealed and confidential cases, documents, and data never show up in Portal. Some domestic-violence information stays public yet cannot be web-indexed because of federal restrictions. Juvenile records are confidential. An expunged record cannot be recovered through an informal web-removal request. In those situations, ask the clerk what the law actually permits.

Access rule: G.S. 7A-109 establishes public inspection of clerk records during regular office hours unless access is prohibited. G.S. 15A-153 addresses the confidentiality effect of criminal expunction, and G.S. 7B-3200 governs juvenile confidential-file and expunction treatment.

The text of G.S. 7A-109 sets the basic clerk-record access rule.

Haywood County court record public inspection statute

Treat the inspection rule as a floor, not a promise. Haywood County court records are open to inspection, but not every item is available online.

Haywood County Court Record Filing

Portal exists for viewing case information and public documents, not for e-filing. Haywood joined the western North Carolina eCourts Track 5 rollout on July 22, 2024. The statewide case-management system is Enterprise Justice. It is also called Odyssey. For actual filings, the Judicial Branch points to a separate File & Serve application.

That split matters for anyone chasing a Haywood County court record. Need an existing record? Use Portal, the terminal, or the clerk. Save the filing application for filings only. Never treat it as a docket search or a shortcut around a clerk copy request.
